IDEA runs on deadlines. Missing one can be a violation of your child’s rights — so it pays to know the clock. (Exact days vary by state; check your state’s page.)
Analyze Your Child's IEP Free →After you give written consent, the school generally must complete the initial evaluation within 60 days (many states use 60; some differ). This determines whether your child is eligible for special education.
If your child is found eligible, the team must hold a meeting and have an IEP in place within 30 days of the eligibility determination in most states. Services should begin promptly after you consent.
The IEP team must review the IEP at least once a year to check progress and update goals and services. You can request a review sooner any time you have concerns.
A full reevaluation happens at least every three years (the “triennial”) to decide if your child still qualifies and what they need — unless you and the school agree it isn’t necessary.
Day counts vary by state. See your state’s page on My IEP Hero’s IEP Help by State directory for the exact evaluation, IEP, records, and prior-notice deadlines where you live.
Commonly 60 days from written parental consent, though the exact timeline varies by state.
At least once a year (annual review), with a full reevaluation at least every three years.
Usually two years from when you knew or should have known about the issue, but this varies by state.
My IEP Hero publishes per-state timelines at /states/ — pick your state for evaluation, IEP, records, and prior-notice deadlines.
